Eight-time world champion Boston Red Sox and owner John Henry may hit a major roadblock after being sued for negligence by a fan.

The woman who was later identified as Stephanie Taubin hails from Boston, Massachusetts. Taubin testified that she suffered facial and neurological damages. It can be recalled that Taubin was hit by a foul ball in 2014 while watching the game live. She added that she underwent three surgeries to recuperate from her injuries.

In a statement released by Boston Red Sox spokesperson Zineb Curran to PEOPLE, the team said that the safety of the fans has always been their top priority. It added that they are continuing to implement safety measures to assure a positive game experience.

“Since 2002, the club has taken the appropriate measures pertaining to the safety and security of our fans, designed to ensure the game experience at Fenway Park is one that is both safe and enjoyable. While this matter remains actively in trial before a jury, we are not at liberty to comment further” the team’s statement reads.

Taubin is expected to appear before a jury next week. She is looking forward to persuading the jury to grant her a $9.5 million for damages.
